Hi all,



The Sarn Helen Byway Road should be open to, (road legal), motorised users for tomorrow. If it’s not open, and you turn up to use it, you are within your rights to move obstructions just enough to permit your vehicle to pass, (provided that you haven’t travelled there specifically to move obstructions). Given that the some of the obstructions are 10-20 ton boulders and large tree-trunks - that is easier said than done!



Energybuild which owns the stretch of Sarn above Seven Sisters does not usually cause any problems, however, if anyone experiences any intimidation / threats, etc. from any of the other Landowners, (yes, I’m mainly referring to Walters Maesgwyn operatives and motorsports organisers who may have hired the site from Walters), please let me know! Also take photos if possible. We are trying to make sure the Police tackle them for every infringement and since the temporary TRO expired it does seem to have made a big difference, since the temporary TRO expired and walkers / riders / cyclists have been able to get onto the site - they’ve been leaving people alone.



R.O.W.A.N. has been fighting hard to prevent the Walters Group from stealing this amenity from the public. It’s been an uphill struggle and is ongoing. This section of road is under great scrutiny and ‘misbehaviour’ only provides Walters ‘friends in Council’ with the excuse that they need to further restrict vehicular access. So, please don’t give them any more excuses. Please;

Stay on the road: If you wander off onto the Walters site or into the forestry or surrounding fields you are liable to get a s59 notice, (your vehicle may be seized if there are future infringements), you may be fined, receive points on your licence, etc. This area is policed by RAFT, (the Rural and Forestry Team). The local Police Sergeant, Geraint Jenkins, is a RAFT member. Sgt Jenkins seems to be generally sympathetic to our position and has been taking a hard-line with the Walters Group over their intimidation of the public but if you’re being naughty on the mountain and he catches you – don’t expect any form of preferential treatment!

With the wind-farm now up and operating, Walters now have permanent security staff throughout the Maesgwyn site 24-hours / 365 days. If you have left the Byway and are using private tracks, given the change in ethos on the site, you are probably far less likely to get confronted, but then you are very likely to get photographed and reported.

Remember it IS a REAL PUBLIC ROAD: Legally you are ‘on-road’ (even if it FEELS like ‘off-road’). You can be charged with numerous motoring offences such as speeding, reckless driving, dangerous driving, etc. If you are there to enjoy a ‘green-laning’ type of experience then you will find few better places to be. If you’re there to tear around the place or create a muddy pit so that you can try out your winch – then you are risking your licence. There are plenty of proper off-road sites where you can enjoy more energetic forms of 4x4 sport.

Respect other rights of way users: You may encounter equestrians and cyclists. You will, almost certainly, encounter walkers. OK, it’s a road but please behave courteously to other users of this highway. Some of the walkers will be part of the Neath & District Walking Club. This Club counts amongst its membership at least one very senior official from the Neath, Port-Talbot Council. This club has provided evidence which helped to increase the duration and effect of TRO and, we believe, wishes to ultimately close this road to motorised vehicular users, (which sits well with the agenda of the Walters Group). If they see 4x4 drivers or scrambler-riders causing damage, behaving aggressively to other road users, driving recklessly, aggressively, etc. Also, the offenders are highly likely to be photographed and reported. A significant proportion of this areas Police force is also extremely 'Walters-friendly' and so reports of motorised misdeeds are likely to receive disproportionate attention. It also helps them to advance their argument to exclude motorised user altogether.

Club Activities: One of the ‘sticks’ we’re using to fight the Walters Group with is the possibly unlawful status of the motorsports they have been holding at the Maesgwyn site. This is a 2 edged argument inasmuch as club activities such as ‘off-road runs’ may need to look at whether they require any of the permissions we’re quoting, (such as land-owners permission / local authority permission, MSA authorisation, etc.) By far the safest way of sorting out a ‘run’ is probably just to make it an event where a few friends get together. If it’s posted on a club website, if there are charges / fees involved, if you’re using club insurance cover, if you’re using public roads, (which include Byways), then you risk being seen to have organised a motor sports event unlawfully on a public road.

if sign says open im doing it and walters and windmills can pissoff i will drive out the other end over them rocks if i have to lol thay block the end last year cozz thay didnt want ppl going on thear windmill site but the gate was poen at all times on the end of banwen rd so was no point blocking it just trying to put us off useing the lane Evil or Very Mad

no bonkas sticker on my truck im ok with lanes being shut cozz pricks going off paste not cozz some land owner uses the road for thear gain farms use em fuck en up walters shut when thay feel like it not write thats all who do thay think thay are we should stand up to em and the counsil should to by no shuting em for some stupid reasn like ppl migt go on my land when im putting up widmills whot a joke im not going up this weekend now doing stuff with family iif i do it willl be with ppl i can trust no ofence to any 1 Cool and got no more to say about it .

done sarn on the first day were boulders on the seven sisters cross and on the edge of walters but managed to get all the way
got stopped by a walters picup he was taking photos to prove to the council the sarn was open
spoke to christopher williams who is fighting to keep it open and he said the boulders were being removed that day

Just for info, the Sarn Helen isn't entirely clear. There were a few obstructions which hadn't been cleared, (most of which have now been cleared after some nagging). Only one remains, approximately 200 meters West of Gnoll Stones. Grid Ref: SN 851 085 (approx).

I have served a 'removal' notice on the Rights of Way Officer. He tells me, at the moment, no-one is owning up to having put this blockage in place but is hopeful that it'll be cleared for next week.

Some guys who had driven the length of this byway on Tuesday told me they'd come across the various obstructions and had managed to bypass them all. This last remaining obstruction has breaks in the fencing before and after it and so it is possible to 'bypass' it by driving onto the adjacent open land then back onto the byway - doing this may not be lawful however.

If you decide to drive out onto this land - just make sure that there's no-one else about!

Also, I spoke with a couple of guys who'd driven over from Aberdulais on Tuesday. They told me that there were Walters site operatives taking photographs of them as they were driving through the site. They had asked why they were doing this and were told that photos were needed to prove that they Walters was permitting motorised vehicular access by the public.

I think that this is a plausible / reasonable explanation if they are doing this for the first few days and I think they are well within their rights to photograph / film anyone who is not road-legal or who is causing nuisance, but if the photographing of 'Joe public' doing nothing more interesting than driving lawfully on a public road does continue then I think that this could be interpreted as, (further), intimidatory tactics. Due to the wind-farm being up and running, there is now on-site security 24 hours a day, 365 days a year at Maesgwyn.

Could you please bear in mind that Walters site operatives may still try to hamper access by various tried and proven tactics.
Cliff Mainwaring, (the so-called 'motor sports academy' manager), is well-known for tackling people on the byways - he drives a green swb Trooper. He is usually very polite, bordering on the charming, but his motivation is straightforward he's going to try 1001 and ploys to get and keep the public off the roads.

If anyone gets any hassle of any description, please let me know!
I would need dates, location, etc. If you've got a camera take a photo of the individuals involved. In my experience with the site-staff, on Maesgwyn, they know they're acting outside the law and as as soon as you pull a camera on them you won't see them for dust!

If you happen to be on site and see organised, (i.e. paying), motor-sports events using the byways - please let me know. Again, dates, times, who and photos if possible.

The tide has turned against Walters, (I think when they obtained their temporary TRO in 2010 they thought they'd shut Sarn Helen for ever), but we do need to keep the pressure up! As it stands, this amenity is not going to be stolen from the public anytime soon but there are probably many more plots and plans in the pipeline to help Walters Group achieve their goal. We have got to keep trying to frustrate their aims and hopefully get them to back off.

I would add that, (based upon 3 files of evidence I've submitted backing up a complaint), there is now an active criminal investigation being conducted into fraud & corruption.
The senior Officer who has consented to this investigation described the corruption in saga I've detailed as 'Massive'. He has also summoned Cliff Mainwaring for a discussion about the corporate abuses of rights of way at Maesgwyn.
The CID Officer dealing with my allegations against the various Councillors, senior Police Officers, Council Officers, local businessmen, etc. has descibed this as 'A scale of fraud & corruption that a detective is only going to encounter once in a career'.

I hope this is the key to stopping the Walters Group's plans for Sarn Helen & Maesgwyn.
