POSTED LAST YEAR ABOUT THE GAP

As I usually do before we go on one of our expeditions I have been in touch with the relevant Right of Way officer. I am sorry to say that Powys CC have confirmed that the Gap Road is now closed to vehicles. It was a long exchange of emails today but basically the Gap Road lost its vehicular rights under the NERC Act however last year when I wrote to the RoW officer he explained that the TRO that had been in place for many years (allowing vehicles 1-31 March and 1 Sept - 15 Oct) was still being allowed to continue. When I checked for this year they are now rescinding the TRO as technically it is not required as the NERC extinguished the vehicle rights and the TRO was a left over from before the Act when it was a RUPP. He stated that having the TRO was confusing which is why it is now rescinded to avoid any further confusion. I'm quite sure that people will drive it thinking it is still in place but I cannot condone any of us doing so now I have had the position clarified.

Personally, I wouldn't go. If it came to a court case its you versis the council.
The outcome, right or wrong (probably wrong) is pretty obvious.
I don't think its worth the risk, or the chance to give councils another excuse to close lanes.
Only my opinion, its up to individuals to decide.

if u take a pic of the sign b4 u drive it and u get caught there is f all the cops can do cos the proof it on the sign ? it will not stand up in court . i think lol

lee how you doing right i spoke to avion jones, he said its closed but as they havnt put signs up stating that its closed you could still drive it, whens it open as i will phone him up and if he says the same i will be driving it as i will record our message, hahahahaha

the thing is rob its a very shady area due to the cops
booking boys when they are up there
